Lawsuits Against BMW And Corbin Seats Dismissed In A Case Of Permanent Erection…

corbinbmwseatOn May 2, 2012 I published the story of a California biker named Henry Wolf suing BMW and seat maker Corbin-Pacific Inc. for “Non-Stop Erection.” (medically called “Priapism.)

Wolf alleged that during 20 months he could not stop an erection following a 4-hour ride on a 1993 BMW K100Rs motorcycle equipped with an after-market Corbin seat. He was looking for financial compensation for not being able to get “normal” sexual relations and suffering substantial emotional and mental anguish.

Jokes aside, the Superior Court of San Francisco just dismissed the 2 lawsuits against BMW and Corbin-Pacific Inc. Judge James J. McBride granted the defendants’ motion for non-suit, essentially ruling the plaintiff did not present enough evidence to support his case. The court tossed out portions of video testimony of Dr. Jonathan Rutchik, a neurologist introduced by the plaintiff, who argued it is possible vibrations from a motorcycle could cause priapism, citing studies conducted in Japan. The court deemed those studies irrelevant to the case and ruled Dr. Rutchik’s opinions were speculative “not supported by a specific causation for plaintiff’s injury.”

    I’m not at all squeamish,but I don’t really want to be in court when the evidence in this case is shown to the Judge.

    Can I order one of these seats? Are different thicknesses available?

    Seems to me both BMW and Corbin missed a great marketing opportunity not settling with this guy and using his testimonial on all their TV and print ads. I like Ilene’s idea for a possible new tag line! =)

    In what country would officials let someone file such a law suit.

    Waste of tax payers money, great media exposure though. I wonder if the guy has any connection to Corbin. Should have a job for life now any way.

    Interesting that the Japanese have been studying this, I wonder if this is something they have been hoping to offer to their domestic market as an accessory……I always wondered why they seemed so happy

    @ James just another Kiwi…the kind of country that allows cases like this to be filed…easy, free countries! Also in a civil case like this the taxpayers don’t pay for anything. The plaintiff must pay all fees to file and defendants typically get their legal fees paid by the plaintiff as well in a separate filing. I would also note for all the talk and media attention frivolous lawsuits get, most of them, just like this one, are thrown out. I suspect were it not for the titilating aspect an erect penis we never would have even heard about the case.

    Bobs you are right there are quite a few of these frivolous court cases reported coming out of the USA.
    One on the news this week was about some girl suing her parents.
    Who gets to pay for that one ? hopefully not the parents

    The general media goes for anything that makes a good headline, not good substance. The problem is most of them come out of the American media..

    Im not sure how free the USA is now after 9/11 when your Govt spy agencies gets the Poms to use their spying agencies to spy on American citizens because they are not allowed to.
    Then there is the use of Drones and many other things we hear that is going on over there.

    I read the Aging Rebel blog and some of the things on there are quite scary for freedom and democracy in general for all western countries.
    Australia is going through similar issues. Recently there has been a whisper through wiki leaks that our Govt might use your Govt to spy on us in return for the USA Govt spy satellite dishes you have deployed in our country. This has not yet been confirmed. But sounds logical

    Technology when uses by the good is beneficial, when used by the bad is frightening and destroys previously hard fought for freedoms.

    I am not a conspiracy theorist , this is just what it is.
    Personally I believe western democracies reached their high water mark between the 1960’s and 80’s.It has been in a slow decline ever since. Rules and regulation’s are on the increase everywhere.
    I guess the dinosaur’s (Bikers) are watching Rome on a very slow burn.
