New Senate Bill Threatening Again California Bikers

californiacapitalCalifornia already has the strictest CARB emission standard in the nation, and a new bill by California State Senator Fran Paveley (D) intends to require all motorcycles (beginning with model year 2000) to be tested in 2012 under the California State’s vehicle “smog check” program. According to standing state California state law, the “smog check” program was designed to service cars. Because of that, motorcycles were to be exempt “until the Department of Consumer Affairs implements test procedures applicable to motorcycles”. Under the new legislation, the department is to prescribe test procedures for motorcycles by July 1, 2011.

Opponents say the bill is simply a thinly veiled attempt to levy yet another fee to offset the California State record budget deficit and points to a recent raid of the OHV trust fund of $90 million dollars for non-OHV related expenditures. The bikes potentially affected are in fact the cleanest in the nation, having already been required to meet the stricter California CARB emissions standards years prior to similar requirements being adopted nationally by the federal EPA.

    Just another case of over legislation and under representation of bikers in California. We’re an easy mark so why not keep screwing us every chance these jerk offs get?

    BOLT (Bikers Of Lesser Tolerance) and the AMA (American Motorcycle Association) are against her bill and are working to defeat it.
    It is correct that she only accepts messages from those in her voting district, Hell they are the only ones that can vote for her so that makes sence.
    For those living in CA it is suggested that they contact the legislator from their district. Hopefully they are registered voters as that does mean a lot to some of these people. Remember some one put them in office But you can have a Vote in if they are there in the future,
    Those out side of CA. can contact the governors office and or tourist bureau and let them know you will Not Be Visiting California and spending your money there.
    Oh that is definately more than they will be making if this bill passes.
    Please realize that for this to become law it has to go through many steps and it is much easier to contact the legislators who will be voting on iit now.
    Yes Those living out side of California this will affect you as well. If this becomes law you can be sure another state will try to pass it as well.

    Information Alert Tell the Senate Transportation and Housing Committee to
    Oppose SB 435
    Bill Would Mandate Smog Testing for On-Road Motorcycles Statewide

    California Senate Bill 435 (Pavley, District 23, D) is currently awaiting a
    hearing in the Senate Transportation and Housing Committee. If adopted as
    written it would mandate all model year 2000 and newer motorcycles be smog
    tested biannually. This despite the lack of any evidence that motorcycles
    are a significant source of emissions statewide.

    In fact the only two counties to ever smog test motorcycles nationwide, Pima
    and Maricopa in Arizona, have already shown that motorcycle testing leads to
    no significant reduction in measured emissions levels. Pima County has in
    fact already dropped their testing program and Maricopa is awaiting EPA’s
    approval to do the same.

    Other important points to consider include:

    Motorcycles, because of their relatively low yearly mileage totals when
    compared to other classes of vehicles, already have the lowest emissions of
    any motor vehicle category in California.

    This bill has no specific information regarding the test method to be used,
    emissions levels to be enforced or the test’s potential costs to either the
    state or the individual owners.

    The deadline proposed for creating a test procedure proposed (July 1, 2011)
    is to close to the test implementation date of January 1, 2012.

    California’s motorcycle engine emission standards were already the strictest
    in the nation and were just reduced again for model year 2008 and up

    If a smog check program is in fact implemented, motorcycles constructed
    prior to the implementation date should be exempted from the testing.

    This is exactly what the problem is. We as a society have sat back for too many years letting this rogue government do as they please. Groups such as the AMA, ABATE and the like lobby against such legislation. It is a comfort to know they are on our side. They are not nearly as effective as every motorcycle owner in the state writing their congressman and expressing their opinion. Until people get off their lazy asses and take part in the process they will continue to get screwed.

    If this passes it will be the start of more to come. A Calif air quality board (not sure if it was just the SoCal district or the whole state of Calif) has passed many things including all old and not so old earthmovers be outlawed from use requiring everybody to invest in new machinery. Starting 2012 they only want 2007 and later diesel trucks on the road. Of course meanwhile our biggest diesel gross poluter is the railways which blast polutants into the air that is exclusive of the same regulations. The start for bikes will be back dating it to 2000 but we that’s most likely just a starting point and will eventually go further back.
    I’ll stick to my old bikes and like Jay Leno once said, we’re doing our bit for the environment and recycling as well as saving the earth from an even larger carbon foot print. By not buying new just think of all the stuff we we’re saving the earth from in the manufacture of a new car. His intent was to have a dig at the clean air/global warming forks.
    Calif is a tough place to do business as it is. Just keep piling it on. “Our government hard at work for we the people”

    Does anyone think that this is anything more than just a jam of the foot in an open door causing it to be ever widened into our pocket books and lives? The govt. (especially the left) continues to broaden its control with the incesant voice of saving us from ourselves and protecting the enviroment. How many toxic and volatile gases were given off by the new volcano that just erupted from under the ocean near Tonga or Mt. Redoubt in Alaska. Probably more than all the motorcylces all put together. Soon they will be taxing us for just breathing!! Watch Glenn Beck on Fox for a breath of fresh air and a voice back towards our Values and Principles that most Americans have always had.

    LOL- any politician who excludes input from ANYONE is, at best, a chickenshit, and could, in fact, be in violation of Constitutional law. I’m sorry, is she not an ELECTED official? Excuses that she limits input because she’s “far too busy” doesn’t wash; After watching her actions regarding the fiasco with bailouts, it’s clear that Fran has WAY too much free time on her hands……….

    Here is what I dont understand why is the poution a problem? The earth will reclaim all that we throw at it. Where do people think that all these chemicals come from Mars? Every chemical known to man has come from the earth and as such the earth will reclaim it in time. I laugh every time I here some one say we are running out of oil the earth produses it daily. We will never run out that is just a way for the oil companies to keep raising prices. Does any one remember the 70’s the oil companies told us we would use all the earth’s oil with in twenty years and yet here we are almost fourty years later and still have twenty years oil supply. The same is true for global warming and all this polution nonsense it is all a sham just a way to create fear and collect money from the fearful.

    Hell, I just found out today that some synthetic oils are not REALLY synthetic and have much much lower flash points. Not blends, I have never used those………….. Apparently the term”synthetic” is just a marketing gimmick? But, what do I know, oil tastes the same after being overheated!!!!!!! peace oh, while I am not afraid of having my bikes tested,(an unnecessary waste of time and expense) I still feel bad for you guys in Cali
