Motorcycle Passenger Legal Rights. Did You Know?

Most people people don’t know the rights passengers have, both as riders in a car and on a motorcycle. Even when you are not the person operating a car or motorcycle you still have protection under the law.

In case of injury as a passenger you may be worried at the idea of filing a claim against a family member or friend. As a matter of fact your own insurance coverage usually covers you if you ride as a passenger (check the extent of the coverage.) And if you have no insurance the claim you make is against the insurance of the operator, not against your friend or family member. You are not obliged to sue a friend or family member to file a claim with his insurance company. His insurance premium may go up, but it will go up anyway if he or she is responsible for the accident.

You also have the right to “just say no” to the offer of a ride from any who can’t explain the physics of turning a scooter or the proper use of the rear brake.
