Recalls For Indian And Victory Motorcycles

Polaris Industries has issued 2 recalls on nearly 700 years 2009 to 2011 Indian Chief motorcycles and one recall on 1,688 years 2004 to 2011 Victory motorcycles.

One recall on Indian Chief motorcycles involves the body control module which can cause the headlight to turn off in some circumstances. If the headlight switch is slowly moved from one position to another (high beam to low beam or vice versa), both beams may illuminate momentarily, which the BCM interprets as an overload condition and then turns off the headlight until the next time the key is turned on. The second Indian recall is in regard of the kickstand that may not fold rearward and upward if it contacts the ground when the motorcycle is moving forward, thus not conforming to the requirements of Federal Motor Vehicle Safety Standard. both problems will be fixed by Dealers in August. Lawsuit And Counter Lawsuit About Sturgis Rally Trademark Use (Part 2)

(From 2 press releases received from Brian Niemann, co-owner of Rushmore Photo & Gifts and Aaron W. Davis, Partner at PATTERSON THUENTE CHRISTENSEN PEDERSEN, P.A)

On July 7, 2011, Rushmore Photo & Gifts, Inc. held a press conference in Rapid City, South Dakota announcing its intention to vigorously defend itself against recent allegations of trademark infringement made by Sturgis Motorcycle Rally, Inc. (SMRI). Indeed, the day before, Rushmore filed counterclaims in federal court seeking the cancellation of SMRI‘s registration for the name ―Sturgis based on fraud on the United States Patent & Trademark Office. Rushmore has also brought other counterclaims, including claims for damages for tortious interference and for false and fraudulent registration of a trademark.

Rushmore‘s counterclaims allege that during the process of obtaining the registration for ―Sturgis, SMRI‘s predecessor, the Sturgis Area Chamber of Commerce, swore under oath to the U.S. Patent & Trademark Office that it was the ―substantially exclusive‖ user of the name  – Sturgis from 1987 through 2001. Rushmore‘s attorney, Aaron Davis from Patterson Thuente IP, stated at the press conference, ―As anybody from Sturgis well knows, the Chamber of Commerce was not by any means the exclusive user and source of goods bearing the name  ̳Sturgis‘ ever, let alone from 1987 through 2001. According to Rushmore‘s claims, the Chamber‘s false statements to the Trademark Office allowed the ―Sturgis registration to issue, but they render the registration invalid and unenforceable. Lawsuit And Counter Lawsuit About Sturgis Rally Trademark Use (Part 1)

On April 6th, I reported  that the  STURGIS® Word Mark in connection with Sturgis® Rally goods and services was now protected by a Federal Trademark Registration. At the time, board member of Sturgis Motorcycle Rally Inc. (SMRI) and longtime Sturgis-area businessman John E. Johnson stated  that it was “an exciting development for the future protection, promotion and long-term health of the Sturgis® Motorcycle Rally, and that this Federal Trademark “also helps to further solidify the future of charitable giving offered from several organizations around the Sturgis area.” Practically, it meant that distributors and retailers of Sturgis® Rally-related merchandise would be now obliged to purchache authorized and officially licensed STURGIS® products simply by sourcing through one of the licensees or official vendors listed at Sturgis Products. (SMRI licensing agent is Lisa Weyer,at 605.347.5336)

Sturgis Motorcycle Rally Inc. made clear that it would sue all those who infringe its intellectual property. One of them going on in U.S. District Court of South Dakota  is against Rushmore Photo and Gifts and its owners. As a matter of fact, this company is much more than a gift shop, it is  a family-owned wholesale distributor  that began its operations in 1937 (before the Sturgis Rally even existed), in fact the largest of its kind in the Midwest Region. It’s a service-based company involved in the production and wholesale distribution of Postcards/Rack Cards, Glassware, Keychains, Magnets, Books, Calendars, Headwear, Collectible Pins / Patches, Apparel, Novelties, and other souvenir related products. Harley-Davidson Forks. Do You Really Know What’s Inside? How They Work?

Sometimes, the most simple technical things need to be explained or re-explained. Progressive Suspension, the largest aftermarket suspension manufacturer in the United States as well as a top tier supplier of suspension components to domestic OE manufacturers and top custom builders, is dedicated to researching and producing the best suspension platforms for each brand and model, American or Metric. David Zemla, its Marketing Director, wrote this very interesting illustrated piece helping you understand what’s going on inside your motorcycle forks and ow they are lowered without affecting the suspension quality.

Motorcycle suspension tends to be something of a mystery with forks at the top of the “what the heck is in there?” list. Sure, there’s a spring and some oil, but did you know there are two springs in each fork? Is the oil just a lube or does it have a bigger job? What happens when I lower my forks? All good questions.

Harley forks generally consist of upper tubes that mount to the triple trees and lower tubes that slide over them and connect to each other via the front wheel. Beginning at the bottom of the lower tube and working our way up, we find a BOTTOMING CUP AND damper rod. The Damper rod AND BOTTOMING CUP are bolted into the lower tube and serve to keep the two tubes from separating, although its primary job is to meter the fork oil pushed through it during suspension stroke. Ribbed Parts From Violent Choppers

In his small Alabama shop, Michael Lewis from Violent Choppers turned these new parts. First, what he calls “Axle Condoms” ($65), ribbed aluminum spacers originally created for Springer 3/4″ axles like old Springer front ends. Objective is of course to make your legs look prettier by covering the front wheel bearings. They taper down to 1″ O.D. to meet up with the rockers/lower legs. Michael will do a custom set for you ($75), whatever your front end style, of course if you give him precise length measurements. Second, a “Rosie Palmer” Jockey Shift knob with a different ribs design, but working very well in complement of the axle covers. Violent Choppers.

Joke Of The Week

Four bikers are walking down a street in Yuma, Arizona . They turn a corner and see a sign that says, “Old Timer’s Bar – ALL drinks 10 cents.” They look at each other and then go in thinking this is too good to be true. The bartender says in a voice that carries across the room, “Come on in and let me pour one for you! What’ll it be, gentlemen?” There’s a fully stocked bar, so each of the men orders a shot of Jack. In no time the bartender serves up four shots and says, “That’ll be 10 cents each, please.”

The four bikers stare at the bartender for a moment, then at each other. They can’t believe their good luck. They pay the 40 cents, down their shots, and order another round. This time they order four beers, with the bartender again saying, “That’s 40 cents, please.” They pay the 40 cents, but their curiosity gets the better of them. They’ve each had a shot and a beer and haven’t even spent a dollar between them. Continue reading ‘Joke Of The Week’

1913 Excelsior-Henderson Gas Tank By Scott Jacobs

Very rare occurrence in the motorcycle industry. When in 1931 Excelsior-Henderson owner Ignaz Schwinn decided to stop production of all motorcycles, the company orders book was full. He was afraid that the great depression would last too many years and preferred to focus on his core business, bicycle manufacturing. A shame when you think that Henderson was producing since 1912 some of the best 4-cylinder motorcycles, adopted as much by sport riders than police departments because they were faster than anything on the roads.

Armed with a twelve camel hair brush as his main tool, internationally renowned artist Scott Jacobs immortalizes Henderson with this extremely realistic close-up of a 1913 Model B. A high caliber piece of art destined to become very popular with collectors and bike enthusiasts. The edition size is strictly limited to 50 examples of giclees on canvas 22´x 32” plus 5 APS and 5 HCS (framing adds approximatively 7” in each direction). Pre-publication orders will receive a discounted price of $1250 (custom framing additional). To order, email ron@tressagalleries.com or call Ron Copple 303-431-4453  Scott Jacobs Studio.

Big Roaring Toyz By Roaring Twinz

During these last years I have seen many American V-Twin Custom Builders crossing over to show their skills using foreign bikes as their platforms, mainly English and sometimes Japanese. More rarely the opposite. Robert Fisher comes from the Japanese Custom Scene where, at a young age, he has already established his name, owning the distinction of being the one of the 1st Builders to create truly radical Kawasakis commissioned by the factory, but also applying his skills to turn Yamaha and Suzuki sport bikes into very fast rolling pieces of art. And now for the 1st time, under the banner of Roaring Twinz, Robert just created this 2011 Harley Davidson Street Glide, an interesting exercise because his objective was to build a custom bagger with lots of style but without sacrificing any of the function of the original bike. Exactly the kind of strict requirement that all oem manufacturer would make to any Custom Builder.  Continue reading ‘Big Roaring Toyz By Roaring Twinz’
