Sturgis Trademarks lawsuits Update. The lawsuit and counter lawsuit between Sturgis Motorcycle Rally Inc. (SMRI) – owner of several Sturgis and Black Hills Rally trademarks – and a group of businesses under the banner of “Concerned Citizens Of Sturgis”opposing these trademarks is still going on with first court dates scheduled in May postponed again. “Concerned Citizens Of Sturgis” attorney has requested sworn depositions of 2 members of SMRI (Jerry Berkowitz’s of “Hot Leathers/Good Sports” and Black Hills Harley-Davidson) who formally opposed and challenged the legality of any geographic location trademarks One can imagine that SMRI’s attorney find less risk for his client and has interest in postponing as long as possible any legal decision until after the 2012 Sturgis rally takes place. During this time, weighing in on the trademark dispute Secretary of State Jason Grant said that South Dakota law doesn’t permit registration of a trademark for a place name for exclusive use. Any trademark registration with a name of location can only be used in connection with additionally descriptive terms distinctive of the applicant’s goods or services.”  “This only could have take place at the federal level, because my office has and will continue to reject similar applications,” Grant said.

City Of Sturgis Facing Risk Of Deficit Because Of Motorcycle Rally. Increased costs to host the rally and decreased revenue is challenging the City Of Sturgis budget. So, actions have been taken to supplement income: an increase of vendor fees by 8 percent, leasing of various city properties during the rally such as city parks and reducing the 2012 formally voted operating budget by nearly $220,000. The City Manager Daniel Ainslie states that the citizens of Sturgis likely do not benefit or actually loose money from the rally. 2011’s rally, including sales tax, brought in $391,000 to the city, however the profits do not include the time spent by city staff, such as the finance office, attorney and human resources. According to the comprehensive plan, the city should work out a strategy to ensure that the city profits at least $1,000,000 from the rally. Rolling Thunder US Navy Tribute Custom Motorcycle

This U.S .Navy theme bike built by Dar Holdsworth of Darwin Motorcycles is one of 4 custom motorcycles unveiled at Rolling Thunder’s 25th anniversary on May 26, 2012 in Washington, D.C. Jay Allen managed the tribute build project with each bike built to honor a branch of the military. Dar being a U.S. Air Force Desert Storm veteran, son of an Army Vietnam Vet and grandson of a WW2 Navy Vet, had a lot of visual references to customize such a project.

While Navy Defense Media filmed this U.S. Navy tribute bike fabrication process to air later on the Armed Forces Network, Dar declared  “We have been involved in some very important builds.  But none more than this.  What Rolling Thunder symbolizes to me is remembrance and honoring those who gave the ultimate sacrifice for our country.” “We, as a country, can never leave anyone behind and never forget. Our servicemen gave their all.  And we are giving our all on this Navy bike to pay tribute. Breaking News. Ex Custom Chrome US CEO Holger Mohr Joins MAG.

Holger Mohr joins Motorsport Aftermarket Group, Inc. (“MAG”), a family of leading brands and businesses in the powersports industry, as Vice President of Business Development for the MAG Brand Group.  In his new role, Mohr is responsible for the growth of international markets and will oversee MAG’s internal design center, Mustang and MAG Europe, among other departments. Pay To Be In The AMA Motorcycle Hall of Fame?

Yes, now you can pay to be in The American Motorcyclist Association Motorcycle Hall of Fame but not as a “Wall Of Famer.” AMA has introduced a new way for individuals and companies to help promote and protect motorcycling’s heritage: It’s called “My Hall of Fame.”

When I went to the parking lot, I found my car had been stolen and I don’t have any insurance. I left my wallet in the cab I took home. I found my wife with another man and then my dog bit me. Washington Post Investigates Dangerous After-Market Motorcycle Parts. How many millions of problem after-market parts not meeting safety and environmental standards and endangering bikers are sold every year is the question that asks the Washington post. The investigation starts with an interview of Rick Doyle founder of now shuttered Hog Farm, a 3-million dollars business selling custom parts. Doyle now worries that the custom parts he sold by the thousands — from undersize mirrors and lights to high-performance carburetors — appear to be dangerous and/or to violate federal standards meant to keep the roads safe and the air clear of excessive emissions.

The National Highway Traffic Safety Administration and the Environmental Protection Agency regulate the industry but admits that it struggles with limited budgets and resistance from some parts of the motorcycle industry and that the laws themselves can be confusing, with nuances that make oversight difficult. NHTSA and federal safety experts also say that equipment failure has not caused a large number of crashes, but that the federal government has not conducted a comprehensive study of the causes of motorcycle crashes since 1981 when the study found that modified bikes were overrepresented in crashes. Harley-Davidson Bar & Shield Logo. Did You Know?

Contrary to popular belief, it’s not in 1903 that the Harley-Davidson “Bar & Shield” logo was created.

It’s only in 1910 that the famed “Bar & Shield” logo is used for the first time. It was trademarked at the U.S. Patent office one year later.

Recently, the licensing of the Harley-Davidson logo and brand for use in other products than those manufactured by the company accounted for about 41 million of Harley-Davidson net revenue. (photo original sign @harley-davidson)

2012 Sturgis Rally. New Free Access To Music, Vending, Entertainment At Crossroads Buffalo Chip.

Worth mentioning to all those who are going to participate to the Sturgis Rally 72nd edition. 3 miles outside Sturgis, a new kind of gathering place at the Buffalo Chip® that provides visitors, without having to pay any admission fee, access to the campground where bikers and guests can visit friends, campers and vendors, enjoy food, drinks, and music.
